Medical malpractice cases entail a legal process aimed at compensating patients for harm suffered while receiving healthcare. Throughout this process, the court may request specific reports that can support compensation claims. Here are the documents commonly requested in medical malpractice cases and their significance:

Documentation of Inappropriate Medical Practices

Evidence such as photographs, videos, or audio recordings taken by the patient or their family can help establish inappropriate medical practices. Such evidence strengthens the malpractice case and assists in demonstrating the negligent behavior of healthcare providers.

Doctor Panel Report

During the legal proceedings, the court may request a doctor panel report. This report is formed through the evaluation of the patient by a medical team, who then provide their expert opinion on the matter. Doctor panel reports are considered crucial evidence that either supports or refutes medical malpractice claims.

International Forensic Medicine Report

For individuals who are not present in Turkey or are difficult to reach, the court may request an international forensic medicine report. This report includes expert medical opinions related to the case, obtained from a recognized international forensic medicine institution. International forensic medicine reports facilitate fair and impartial evaluations of the case.

Medical Records

The medical records of the patient are central pieces of evidence in a medical malpractice case. These records document the patient's medical history, the medical decisions made, and the procedures undertaken. Thorough examination of medical records is essential for supporting the malpractice claim and identifying potential errors.

Process for Obtaining a Judicial Forensic Medicine Report: If the court decides that a forensic medicine report is necessary, the plaintiff/patient is directed to this institution. Here, consultations and examinations are conducted by a doctor panel. In Turkey, forensic medicine reports are typically provided by the Forensic Medicine Institution. However, for obtaining such a report internationally, the process involves utilizing the international legal assistance mechanisms.
